By accessing or using the Flockar mobile application (the "Service") operated by Flockar Technologies ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
To use our Service, you must register for an account by providing accurate, complete, and up-to-date information, including a valid phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
The Service is designed to share location, movement history, battery status, and safety alerts within authorized private groups ("Nests"). By using the Service, you explicitly consent to the collection, transmission, and sharing of your location data (including background location tracking when the app is closed) with members of the Nests you actively join.
You can turn off location sharing for specific Nests at any time directly through the app settings.
IMPORTANT DISCLAIMER: Flockar is a family convenience and situational awareness tool. It is NOT a replacement for professional emergency services (such as 911/police/ambulance). We do not guarantee the transmission of location data, alerts, or SOS notifications, as they rely on third-party mobile networks, battery levels, GPS satellite availability, and device settings. In any emergency situation, you must contact local emergency services immediately.
You agree not to use the Service to stalk, harass, monitor, or track any individual without their explicit, ongoing consent. You must not use the Service for any unlawful or unauthorized purpose. Failure to comply with these rules will result in the immediate termination of your account.
To the maximum extent permitted by applicable law, Flockar Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of the Service.
These Terms shall be governed and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
